Do I Need an Expert Witness Surveyor for a Property Dispute?

What Is an Expert Witness Surveyor?

An expert witness surveyor is a qualified professional who provides independent, factual evidence in legal or dispute matters. Their role is not to argue one side, but to help the court or parties involved understand technical issues related to property.

What Makes These Reports Different?

Unlike standard survey reports, expert witness reports must:

  • Follow the Civil Procedure Rules (CPR Part 35)
  • Set out technical facts clearly for legal or non-technical readers
  • Include a signed declaration of duty to the court

This ensures the evidence can be relied upon in legal settings without bias or conflict.

Single Joint Expert vs. Party-Appointed Expert

In many cases, the court or solicitors will ask both parties to agree on a Single Joint Expert (SJE). This simplifies the process, reduces costs, and avoids conflicting reports. In other situations, each party may appoint their own expert surveyor.
