This notice explains what personal information Lyman Marshall Chartered Surveyors collects when you use lmsurveyors.co.uk or use our services, why we collect it, and what rights you have over it. We are the “data controller” for that information, which means we decide how and why it is used.

The information we collect

When you send an enquiry

If you use the enquiry form we collect your full name, email address, phone number, where you heard about us if you tell us, your message and the page you sent it from. The form is only sent once you tick the box agreeing that we can use these details to respond to your enquiry. It sends your enquiry to us, and a copy may be kept securely in the website. If you phone or email us we keep that conversation so we can reply and refer back to it.

When we carry out a survey or valuation

To quote for and carry out a survey, valuation or other instruction we record your name and contact details, the address of the property and how we can get access to it, the notes and photographs taken during the inspection, the report we produce and the invoice. We need this to carry out the work, to answer any questions about our report later, and to keep the records our professional body and the law require.

When you browse the site

With your consent, we use two analytics tools to understand how people find and use the site — which pages are visited, roughly where visitors are, and what device they use: Google Analytics (measurement ID G-VFYLZTC226), and the site analytics service provided by WPMU DEV, which uses Matomo. Both set cookies in your browser to do this. These cookies are not set unless you accept them, and you can change your mind at any time using “Cookie settings” at the bottom of every page. Declining does not affect your ability to use the site.

Maps on our site are provided by Google Maps and only load if you allow them. The customer reviews on our home page are shown using Trustindex, which loads the reviews and reviewers’ profile pictures from its own and Google’s servers.

The site uses Google Fonts to display text. When a page loads, your browser requests the fonts from Google, which receives your IP address. Google Fonts does not set cookies.

Our hosting and security systems also keep standard server logs, including IP addresses, which help us keep the site available and protect it from abuse. We keep a record of the cookie choice you make (a random ID, your choices and the date — not your IP address) for up to two years, so that we can show we asked for your consent.

Why we are allowed to use your information

UK data protection law requires us to have a lawful basis for using your information. Ours are:

  • To take steps at your request and to perform our contract with you — answering your enquiry, quoting, carrying out the work and taking payment.
  • Our legitimate interests — keeping records of the work we have done, dealing with any warranty or guarantee, preventing spam and fraud, and keeping the website secure. We use this basis only where it does not override your own rights.
  • Your consent — analytics cookies, and loading maps. You can withdraw consent at any time.
  • Legal obligation — keeping the accounting records that tax law requires us to keep.

Who we share it with

We do not sell your personal information, and we do not share it for anyone else’s marketing. We do share it with the suppliers who help us run the business:

  • Google — analytics (only if you accept analytics cookies), maps (only if you allow them) and web fonts.
  • WPMU DEV — site analytics (only if you accept analytics cookies) and the tools we use to manage the website.
  • Our website host, email provider and IT suppliers — who store the site, its data and our email on our behalf.
  • Our professional indemnity insurers and professional advisers — only where needed to deal with a question or claim about our work.

We may also disclose information where the law requires it, or to establish or defend a legal claim.

Sending information outside the UK

Some of the suppliers above, including Google, may process information outside the UK. Where that happens, the transfer is covered by safeguards approved for use in the UK, such as the UK Addendum to the EU Standard Contractual Clauses or a data bridge (adequacy) decision.

How long we keep it

  • Survey reports, inspection notes and photographs — up to 15 years after the survey, because a claim about a survey can be brought up to 15 years later under the Limitation Act 1980.
  • Invoices and accounting records — six years after the end of the relevant tax year, because HMRC requires business records to be kept for that long.
  • Enquiries that do not become instructions — kept while they are useful for answering you, then deleted.
  • Site analytics (Matomo) data — retained by WPMU DEV for the period its site analytics service keeps it.
  • Analytics data — retained by Google for the period set in our Google Analytics configuration.
  • Cookie consent records — two years.

Your rights

Under UK data protection law you have the right to:

  • ask for a copy of the personal information we hold about you;
  • ask us to correct anything that is wrong;
  • ask us to delete information we no longer need to keep;
  • ask us to restrict how we use it, or object to us using it;
  • ask us to transfer it to you or another provider in a portable format;
  • withdraw consent at any time, where consent is what we relied on.

To exercise any of these, email info@lmsurveyors.co.uk. We will respond within one month. There is normally no charge.

Complaints

If you are unhappy with how we have handled your information, please tell us first so we can try to put it right. You also have the right to complain to the Information Commissioner’s Office, the UK’s data protection regulator:

Cookies

Our Cookie Policy lists each cookie this site uses. You can change your choices at any time using “Cookie settings” at the bottom of every page.

If we change how we use personal information we will update this page and change the date at the top. Please check back from time to time.
